General terms and conditions of sale

Background

The Company RADAR LEATHER DIVISION S.r.l., also known as RADAR 1957 with headquarters in Via Pistoiese 51, 50054 Fucecchio (FI) Italy, Tel. +39 0571 22047, Email: info@radar1957.it, Tax/VAT Code 03832860484, REA Number FI-394578, PEC: amministrazione@pec.radar1957.it (hereinafter also only the "Seller") sells products for professional equipment, hunting accessories, and personal safety and defense products (hereinafter also only "Products"). It should be noted that the Seller does not market firearms or other types of weapons.

These General Conditions of Sale apply to all sales of Products concluded through the sales channels made available by the Seller, including those concluded at a distance and/or online through the websites"www.radar1957.it" and"www.radar1957.com" (hereinafter both referred to as the "Site").

The general terms and conditions of sale set out below are governed in accordance with and in compliance with the relevant national and European regulations in force, including Legislative Decree No. 70/2003, Legislative Decree No. 206/2005 as amended (hereinafter, the "Consumer Code"), European Directive No. 2011/83 EU on Consumer Rights and by the provisions of the Civil Code for what is not expressly provided for herein. (hereinafter, the "General Terms and Conditions of Sale" or "General Conditions" or "Terms of Sale").

Definitions

By Customer is generally meant the natural or legal person who purchases one or more Products offered by the Seller on its sales channels either for purposes unrelated to any entrepreneurial or professional activity carried out ("Consumer") or for purposes functional to their entrepreneurial or professional activity ("Professional").

Professional means the natural or legal person acting in the exercise of his or her entrepreneurial, commercial, craft or professional activity, or an intermediary thereof.

Consumer means the natural person who, when purchasing Products, acts for purposes unrelated to any entrepreneurial or professional activity carried out.

Product means any tangible movable property, including for assembly marketed on the sales channels offered by the Seller.

Purchase Order (or also "Order") means the document -in digital format- sent by the Customer to the Seller at the end of the purchase procedure. It is binding on the Customer, presupposes full knowledge of these General Terms and Conditions of Sale and acceptance of them by the Customer including the right of withdrawal and the Privacy Policy.

Purchase Order Confirm ation (or "Order Confirmation") means the email sent by Seller to Customer upon receipt of the Purchase Order and implies acceptance of the Purchase Order by Seller.

Privacy Policy means the document contained on the Site by the same name that informs Customers about the processing of their personal data https://www.radar1957.it/privacy-policy and https://www.radar1957.com/privacy-policy.

1. Scope of application.

1.1 These General Conditions govern the sale of Products offered by the Seller to its Customers through the sales channels used by the latter. Before proceeding to the purchase of Products, the Customer must carefully read the General Conditions of Sale, made available to users in the special section of the Site called "Terms and Conditions".

The sending of the Purchase Order to the Seller, that is, the purchase concluded by the Customer directly in store, presupposes the total and absolute knowledge of these General Conditions of Sale and implies their full acceptance by the Customer.

If the Customer is a Consumer, once the online purchase procedure is concluded, he/she shall print or save an electronic copy and in any case keep these General Terms and Conditions of Sale, in compliance with the provisions of Articles 3 and 4 of Legislative Decree 185/1999 on distance selling.

The provisions of these General Terms and Conditions of Sale and the Consumer Code (which is intended to be expressly referred to) for the protection of "consumer" shall apply exclusively to Customers classifiable as Consumers.

1.2 These Terms and Conditions of Sale may be amended by the Seller at any time. Any changes will be in effect from the time they are posted on the Site in the "Terms and Conditions" section. Before making any purchase, Customers are encouraged to consult the most up-to-date version of them. In any case, the applicable Conditions of Sale are those in force on the date of transmission of the Purchase Order for a product by the Customer.

1.3 These General Conditions do not regulate the sale of products offered by parties other than the Seller, even if there is an explicit reference to such products on the Site through links, banners or other hypertext links. Therefore, the Customer is invited, before proceeding to place orders and/or purchase products and services from parties other than the Seller, to check the general conditions of sale applied by the latter. The Seller cannot in any way be held responsible for the supply of goods or services by third parties or that have been sold to the Customer by another supplier even by means of hypertext cross-references/links/banners on the Site.

1.4 Please refer to the content on the Site in the "Privacy Policy" area for information regarding the processing of Customers' personal data.

2. Conclusion of the Contract

2.1 In distance and online sales, in order to conclude the contract for the purchase of one or more Products, the Customer must place a Purchase Order for the Products. The contract is concluded when the Customer receives from the Seller, at the e-mail address indicated, the confirmation of the Purchase Order. The confirmation e-mail will contain the date and time of execution of the order, the essential characteristics of each product ordered, the price (including applicable taxes or duties), any shipping costs to be borne by the Customer and a "Customer Order Number", to be used for any further communication with the Seller, which must also be indicated in the reason for the Bank transfer of payment.

2.2 By transmitting the Purchase Order, the Customer accepts and undertakes to observe, in its dealings with the Seller, these General Terms and Conditions of Sale - including the information on the right of withdrawal referred to in Article 11 of these Terms and Conditions of Sale and any further information contained on the Site and in the "Privacy Policy" area.

2.3 The Seller reserves, in any case, the right not to accept Purchase Orders that are incomplete or incorrect or in case of unavailability of the Products.

2.4 If the Seller does not receive payment within 5 days after sending the e-mail confirming the Purchase Order, it will send the Customer a payment reminder e-mail. If, after a further 5 days following the sending of the reminder e-mail, the Seller does not receive payment, the contract shall be deemed to be terminated as of right.

3. Online purchases via Site

3.1 Purchase Orders may be directly placed by the Customer, through the Site, only by persons of legal age who are not in a condition of legal incapacity.

3.2 For purchases through the Site, in addition to what has already been expressed in Article 2 above, the Customer completes a purchase order by means of an order form in electronic format to be transmitted to the Seller electronically following the instructions provided by the Site during the online purchase procedure; before concluding the purchase, he/she has the right to correct any errors in data entry. The Customer may register with the Site by entering the required data and creating login credentials. It is necessary to provide the Seller with a valid e-mail address in order to enable it to send to the Customer all information relating to the purchase order as well as the communications provided for in these General Terms and Conditions of Sale.

3.3 The Site registration credentials (e-mail address and password) are to be used exclusively by the Customer and may not be transferred to third parties. The Customer agrees to keep them secret and ensure that no one has access to them. The Seller shall in no case be responsible for the improper or abusive use of the credentials even by third parties other than the Customer.

3.4 The Customer will find indicated on the Site for each product the "product sheet" containing the description and characteristics of the same, together with one or more representative images. The images and descriptions in each "product sheet" reproduce as faithfully as possible the characteristics of the Products but must always be understood as indicative. For the purposes of concluding the purchase, the Customer must consider as actual only the description of the product contained in the purchase order and in the relevant confirmation e-mail sent by the Seller.

3.5 To view the selected Products and their total price it is necessary to click on the shopping cart icon. It is recommended to check the correctness of the contents of the shopping cart before confirming the Purchase Order of the Products. The Customer, at the time of sending the Purchase Order, also confirms that he/she knows and accepts in full these General Terms and Conditions of Sale, to which reference is made via links, including the information on the right of withdrawal referred to in art.11 below and the Privacy Policy, which will be considered in any case read, known and accepted at the time of transmission of the Order.

3.6 The Customer, may cancel the order peremptorily within and not later than 2 (two) hours from the sending of the order to the Seller by giving timely notice to the email address: info@radar1957.it and by contacting our operators at: +39 0571 22047.

4. Pricing of Products

4.1 All prices of the Products are expressed in Euro and are inclusive of VAT. Any taxes, duties and duties applicable in the country of destination of the Products, where this is different from Italy, will be borne by the Customer.

4.2 The Seller reserves the right to change the prices of the Products at any time; any price changes will not, however, be applied in respect of Customers who have already submitted a Purchase Order to the Seller.

4.3 In the event that a Product is offered through the Site at a discounted price, the full reference price against which the discount is calculated will be indicated.

4.4 At Seller's discretion, certain offers on Products may be reserved, even on a temporary basis, exclusively for purchases made through the sales channels indicated by Seller from time to time (e.g. exclusively to online sales through the Site, or in-store sales, etc.).

5. Delivery Charges

5.1 Delivery costs are borne by the Customer and are specifically stated in Euros and inclusive of VAT in the purchase order and in the confirmation e-mail sent to the Customer.

5.2 Delivery costs may vary in relation to the delivery method chosen and/or in relation to the payment method used and the quantity/weight of the products. In particular, payment by cash on delivery may incur a surcharge compared to the other available payment methods.

5.3 There may be a surcharge for smaller islands or inconvenient locations, which will be communicated by Customer Service upon completion of the order.

5.4 The Seller reserves the right to arrange promotions that include free shipping upon reaching certain purchase amounts or at particular times of the year. Such promotional conditions, when available, will be clearly indicated on the Site.

6. Payment and Billing Methods

6.1 Payment by the Customer may be made in Euro by one of the payment methods indicated on the Site and listed below:

Credit Card: confidential credit card data (card number, cardholder expiration date, security code) are encrypted and thus transmitted to the payment processor. Therefore, the Seller never has access to and does not store the data of the credit card used by the Customer for the payment of the Products, not even if the same proceeds to save the Credit Cards, except only the data relating to the card holder.

PayPal: payment for Products purchased on the Site may be made through the PayPal payment solution. If the Customer chooses PayPal as a means of payment, the same is redirected to the site www.paypal.it where he/she can make payment for the Products according to the procedure provided for and governed by PayPal and the terms and conditions of the contract agreed by the Customer with PayPal. The personal data entered on the PayPal site will be processed directly by PayPal and will not be transmitted or shared with the Seller. The Seller is therefore not able to know and does not store in any way the data of the credit card linked to the Customer's PayPal account or the data of any other payment instrument connected with that account.

Cash on delivery: by choosing this mode, payment is made to the Courier upon delivery of the product. Payment is allowed by cash, respecting the limit allowed by Law or bank draft. The Seller reserves the right to require payment only by electronic methods (credit cards, paypal and bank transfer) in the event that on the occasion of a previous purchase, the Customer has not provided for the withdrawal of the products for which payment by cash on delivery was expected, after 10 days of receipt of the email notifying the stock of the products themselves. Please note that payment by cash on delivery may result in higher shipping costs than other methods of payment.

Bank transfer: during the purchase process, you can select bank transfer as the payment method. The IBAN to be used to make the transfer is indicated in the "payments" section of the Site. Upon receipt of the credit, the goods can be duly shipped.

Ri.Ba. (reseller only): This payment method is reserved exclusively for professional customers credited as resellers. Details for this payment method are provided directly to the reseller during merchant account activation.

7. Delivery of Products

7.1 Deliveries of the Products are made only within the territory of the European Union.

7.2 For any information regarding delivery, the Customer may contact the Seller's Customer Service, whose contacts are indicated in the "Support" area of the Site.

7.3 For the Seller, the obligation to deliver the Goods shall be deemed fulfilled upon transfer of the physical availability of the Goods to the party in charge of transportation/shipping.

7.4 Before finalizing the purchase will be indicated the estimated date of shipment of the Goods, which may vary depending on the geographical location of the Customer and the mode of delivery. In the event that the Purchase Order relates to more than one Product, for which different shipping times are envisaged between them, the estimated date for shipping shall be considered to be the one referring to the item whose shipment is scheduled last. Standard delivery times for goods in stock range from 24 hours to 5 business days. For products not in stock at the time of order, the standard delivery time is 30 days from the time of order, unless otherwise notified to the Customer.

7.5 Shipping terms start from the moment the Seller receives payment. If payment is made by cash on delivery, the Customer may be contacted by the Seller for further confirmation of the Order. Under no circumstances may the Customer ask the Seller to postpone the date of shipment of the purchased goods.

7.6 The purchased Products will be delivered by a courier chosen by the Seller, to the address indicated by the Customer in the purchase order, according to the costs and terms stated during the purchase procedure. Delivery of the Products will be made "curbside" in all cases. The Customer may request to take advantage of the "Advance Notice of Delivery" service, which allows to know and opt in advance the time slot for delivery of the goods with an additional charge of 5 euros to be paid at the time of the conclusion of the Purchase Order.

7.7 If the Order includes bulky items these may be shipped on a platform, which will be delivered to the Customer together with the items, the disposal of the platform being the sole responsibility and care of the Customer.

7.8 If after three delivery attempts by the courier it has not been possible to deliver the goods to the addressee, the Seller will send an e-mail to the Customer to notify that the product is in stock. From this moment, the Customer may pick up the goods at the retained warehouse within 10 days, after which the Seller shall be entitled to collect the product by returning to the Customer the amount paid by the latter for the purchase, with the exception of shipping costs that will still be borne by the Customer.

7.9 The Seller shall not be liable for non-delivery or delayed delivery due to force majeure, such as but not limited to strikes, Public Authority measures, rationing or shortages of energy or raw materials, transportation difficulties, fires, floods, heavy snowfall, flooding and damage to industrial machinery not dependent on the Seller. As soon as Seller becomes aware, it shall promptly notify Customer of the occurrence of force majeure.

7.10 The Customer's choice of courier is excluded. In case of loss/damage of the Products due to causes not attributable to the Seller if the Customer is a Consumer, Article 63 paragraph 1 of the Consumer Code shall apply.

8. Conformity of Products

8.1 It is the Customer's responsibility to check the condition of the Products delivered.

8.2 It is the Customer's responsibility, at the time of delivery of the goods, to check that the packaging is intact, undamaged or otherwise altered, even in the sealing materials (so-called "quality check"). Any damage and / or alteration of the packaging must be immediately reported to the courier who makes the delivery and, in this case, the Customer has the right to accept the goods with a "cautious reserve" to be written in the DDT of the courier: E.g.: "box with holes on the side", "open box and without custom tape", "damaged box", etc.. Under no circumstances may the Customer carry out the verification of the integrity of the Products contained in the packaging in the presence of the courier at the time of delivery, without prejudice to the Customer's right to "accept with reservation".

8.3 In the event that the product has been damaged during transport, the Customer must notify the Seller by e-mail within the next 24 h, detailing the damage that the product has suffered. In addition in order to take advantage of the insurance included in the price, any damage must be reported within a maximum of 24 h from receipt of the goods to the following address info@radar1957.it or by registered mail to the address: Via Pistoiese 51, 50054 Fucecchio (FI) Italy.

9. Compliance defects

9.1 The Products must be inspected by the Customer in order to ascertain that they correspond to the items ordered and that they do not have any defects or further conformity defects.

9.2 In the event of a lack of conformity, the Customer has the right to restore, without cost, the conformity of the goods by repair or replacement, or to an appropriate reduction of the price or termination of the contract.

9.3 The legal guarantee of conformity of goods, provided for in Articles 128 ff. of the Consumer Code, is equal to 24 months: the Consumer forfeits this right if he does not report the lack of conformity to the Seller within 2 (two) months from the date on which he discovered the defect. For customers who do not fall into the category of "consumers", the legal guarantees provided by Italian law and article 1490 et seq. of the Civil Code are applicable.

9.4 The lack of conformity of the product must be reported to the Seller by contacting Customer Service at +39 0571 22047. It is also recommended to report to the above address any obvious signs of tampering or alteration of the packaging.

10. Right of withdrawal for the Consumer

10.1 If the Customer is also a Consumer, he/she may exercise the right of withdrawal without penalty and without specifying the reason by returning to the Seller all or part of the Products purchased within 14 days from the date of receipt of the goods or, in the case of multiple goods ordered by the Customer by means of a single order and delivered separately, from the day on which the receives the last product ordered.

10.2 It is sufficient for the Customer to notify the Seller of the wish to exercise the return by accessing the websites https://www.radar1957.it/supporto or https://www.radar1957.com/supporto, opening a ticket in the "Return Procedure" section or by sending a request via RMA form (available on request) to the email address info@radar1957.it or via PEC to the address amministrazione@pec.radar1957.it, indicating for each item to be returned: order number, invoice/order date, item code, quantity and reason for return.

10.3 In order for the return to be accepted by the Seller, the Products must be returned within the peremptory term of 14 (fourteen) days from the date on which the Customer has notified the Seller that he/she wishes to make the return by sending the return form and in compliance with all the conditions below:

  • the Products must be returned complete with all original packaging (boxes, accessories, tags, protections, etc.);
  • the Products must be accompanied by the purchase receipt;
  • the Products returned by the Customer must not have been opened, used, damaged, but may have been manipulated and inspected to establish their nature and characteristics;
  • any damaged Products that are the subject of the return must be returned as received by the Customer, without the Customer subjecting them to modification, manipulation or attempted repair.

10.4 In case of withdrawal, all payments made in favor of the Seller, according to the payment method chosen for the purchase, shall be refunded to the Customer, except for the following expenses which shall remain the responsibility of the Customer:

  • initial costs, if any, incurred in shipping the Purchase Order;
  • expenses related to the return of the goods;
  • any expenses incurred for cash on delivery payment.

In case of withdrawal, shipping costs are borne by the Customer. The refund will be made, without undue delay, within 14 days of receipt of the returned Products and after verification of the integrity of the same by the Seller. The shipment, until the certificate of receipt by the Seller, is under the responsibility and risk of the Customer. In case of cash on delivery payment, the Customer must indicate the IBAN on which he wants the purchase costs incurred to be refunded.

10.5 In the event of damage to the goods during transport for return, the Seller, upon discovery of the damage, will notify the Customer of the incident (within five working days of receipt of the product in its warehouses), to allow the Customer to raise a timely complaint against the courier chosen by him and obtain reimbursement of the value of the product (if insured by the Customer). The Seller shall not be liable for damage, theft or loss of products returned by uninsured shipments at the Customer's care and expense.

10.6 The right of withdrawal lapses in case of defect of the substantial integrity of the returned goods, and so exemplified by:

  • lack of the outer packaging and/or the original inner packaging;
  • absence of integral elements of the product (accessories, cables, manuals, parts, etc.);
  • damage to the product;
  • abnormal state of preservation.

In the event of the Customer's forfeiture of the right of withdrawal, the Seller will return the purchased product to the Customer, charging the same for shipping costs.

10.7 The provisions on the right of withdrawal provided by the Consumer Code apply exclusively to protect the Consumer and, therefore, do not apply to other categories of customers, for whom this right must be understood to be expressly excluded.

11. Sales restrictions and specific regulations

11.1 The Customer acknowledges that certain products marketed by the Seller, such as but not limited to handcuffs, batons, friezes, uniforms and other law enforcement accessories, may be subject to specific sales restrictions under applicable law.

11.2 The purchase of such products may require the Customer to possess specific licenses or authorizations. Customer agrees to verify, prior to making the purchase, that it possesses the necessary authorizations and agrees to provide, upon Seller's request, documentation evidencing such requirements.

11.3 The Seller reserves the right to refuse orders for products subject to sales restrictions if the Customer does not prove possession of the legal requirements for their purchase.

11.4 The Customer agrees to comply with all applicable regulations regarding the possession, use and transportation of the purchased products. The Seller disclaims any responsibility for the improper or illegal use of the products by the Customer.

11.5 It is reiterated that the Seller does not sell firearms or other types of weapons, limiting itself to the sale of accessories, equipment, and products related to safety and self-defense in accordance with applicable regulations.

13. Privacy

13.1 The Customer can always obtain information on how the Seller processes his/her personal data by accessing the "Privacy Policy" area available on the Site.

14. Product categories.

The main products marketed by the Seller are divided into the following categories:

  • Holsters and gun carrying accessories
  • Law enforcement belts and accessories
  • Professional tactical equipment
  • Leather items for hunting
  • Technical clothing
  • Safe carrying and harbor systems
  • Security and self-defense accessories
  • Military and law enforcement buffets
  • Personal safety products

It should be noted that although some products are ancillary or complementary to the use of weapons, the Seller does not directly market firearms or other types of weapons, limiting itself to the sale of accessories, equipment and products related to personal safety.

15. Complaints

15.1 If the Customer wishes to file a complaint against the Seller it can be submitted through the ODR platform (Online Dispute Resolution Platform), operated by the European Commission.

16. Limitation of liability

Notwithstanding the foregoing, for the cases expressly regulated below:

16.1 The Seller shall not be liable in case of delays in the delivery of the Products offered for sale due to insufficient stock at its suppliers.

16.2 To the extent permitted by law, the Seller shall not be liable in the event that the Products delivered do not comply (in whole or in part) with the legislation of a country of delivery other than Italy.

16.3 The Seller is also not liable in the event of insubstantial differences between the Products purchased and their illustrative images and text descriptions published on the Site.

16.4 Except in the case of willful misconduct or gross negligence, the Seller shall only be liable for any direct and foreseeable damage at the time of the conclusion of the purchase of its Products. Therefore, the Seller shall not be liable for any indirect or other damages or costs, including but not limited to any loss suffered, lost profits or any other damages that are not an immediate and direct consequence of its breach of contract or that were not foreseeable at the time of the conclusion of the purchase of the Products.

16.5 The Seller shall not be responsible for the performance of obligations against third parties (other than the Seller and its group companies) that may offer commercial guarantees in relation to their products offered for sale on the Site or in the Seller's stores.

17. Applicable law and place of jurisdiction

17.1 These General Conditions of Sale are governed by Italian law.

17.2 For any dispute relating to the application, execution and interpretation of these General Conditions of Sale:

  • if the Customer is a Consumer, the Court of the Customer's place of domicile or residence, or, at the Customer's choice, the Court of Florence shall have jurisdiction;
  • if the Customer is not a Consumer, the court of Florence shall have exclusive jurisdiction.

19. Changes and updates

19.1 The Seller reserves the right to amend these Terms and Conditions at any time by posting the updated version on the Site.

19.2 The amendments shall come into effect from the time of publication on the Site and shall apply only to purchases made after that date.

19.3 The Customer is encouraged to regularly consult the General Terms and Conditions of Sale before making any purchase.

20. Final Provisions

20.1 Should one or more provisions of these General Terms and Conditions of Sale be held invalid, illegal or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

20.2 Failure of the Seller to exercise any right under these General Terms and Conditions of Sale shall not constitute a waiver thereof unless expressly stated otherwise.

20.3 These General Conditions of Sale constitute the entire agreement between Seller and Customer with respect to the subject matter hereof and supersede any prior agreement or understanding between the parties.

21. Corporate information
